2024 Current Guidelines

Payments
🔹Payment via CashApp, Paypal, or Etsy(Klarna Installments*)
🔹Installment pay is encouraged!
🔹Deliverables Provided after payment is made in full.

Contact and Communication
🔹Once you’ve added your Commission Request to my Queue, I will be notified and will contact you during business days via message or text you’ve provided.
🔹I work Monday through Friday and am usually at art shows on weekends, so I may not be able to answer messages during weekends, but I will contact you.

Delivery Method
🔹I use a Trello Board and you will receive a share link to your files as work is progressing & once artwork is completed.
– Original high-resolution (300 DPI), PNG format.
– A lower-resolution online version with my watermark.
– Other file types available upon request.
🔹I usually complete these commissions within 2 to 5 weeks.

PROCESS & REVISIONS
1. Make your request (pay how you wish)
2. Wait for the Link to your Trello Card to see where in My Queue you’ve landed. (You may then add notes, reference photos, emoji’s, questions there on your Queue Card; as most of our interaction will transpire there to keep things organized.) Please do not comment on someone else’s card even if you know them, tsk tsk. NOTE: if in case you have not received your Trello Queue Card link within 7 days of payment, please CONTACT ME.
3. Celebrate with wine or tea as you await your notice that I’ve begun work on your Queue Card. (It will show REFUND NOT AVAILABLE, once this card is moved into the ACTIVE work list.
4. Once work begins, you may follow your card as I post sketches, drawings and semi- finals to show how progress is moving along. (herein, you are allowed ONE revision/change before final)
5. When the work is noted as SEMI-FINAL it will not switch over to FINAL unless your approval is stated on your commission’s Queue Card.
6. Once the commission is marked as FINAL, I will post your print release and send your final files. (If you opted to have this 10 x 10 printed and shipped to you (US & Canada), I will post your tracking # on your Queue Card)
7. EMBELLISHMENT Add-on: If you have opted in and paid for the addition of painted embellishments (Paypal ONLY +$25 to studio.nini.official@gmail.com) on your printed piece, your card will be noted as having a One-Of-A-Kind status and a Certificate of Authenticity will be sent in the shipment along with your 10 x 10 piece. (*you also get a Gold Star on your Queue Card* because I like giving out gold stars) (PAYPAL.me LINK: https://paypal.me/spooniartwork?country.x=US&locale.x=en_US )
8. TIPS: Paypal ONLY . If you’ve enjoyed both the process and the piece, tips are always welcome. They go to good use as I put most of the money I make BACK into Studio.Nini in order to provide better service (and support other creators I’ve met. Muah)
9. Once either the tracking number is provided or the FINAL files are uploaded, Your Commission’s Queue Card is moved into the COMPLETED Commissions list and no further changes or revisions are allowed. Should you wish for any further modifications to the piece, a new commission request would need to be ordered and the process begins anew.

What I draw
– Characters (Originals or Fanart) – I specialize in fantasy, horror, & floral.
– SFW of course
– SUGGESTIVE SFW allowing for artistic nudity (🚫insertion, explicit, or overt)
– Some fetish (depends on the type of play, if you have a question about if I’ll do it…ask first)
– Requests with dark aesthetics are very welcome!
– D&D and other fantasy characters are very welcome! Note: I only paint or draw in my style (see images or my portfolio). Please take this into consideration before commissioning my style for your Original Character.

What I do not draw
– Excessive gore (I save war scenes for myself)
– Violence or Abuse
– CSAM
– Homophobic, transphobic, or racist imagery
– Art styles other than my own

About design work and references
These commissions do not include any design work – Please have a clear visual idea or reference(s) showing the design of the character. Note: Should you need to, email me your references before or with your request if you have any questions.

What I need from you:
1. Clear, pre-existing reference photo(s)
2. Clearly stated descriptive text. It is important to have all the pertinent design elements stated up front. (if there is a small hoop earring in the left ear and two pair of subdermal studs at the bridge of the nose, STATE THIS. upfront)
Char name, fantasy race & personality
Eye, skin, hair color/style, scars, unique pupil shape
Materials/clothing, accessories/gadgets
Expression, profile, front or semi-profile(3/4view)
Ref images uploaded after Req (Hero Forge refs encouraged)

REFUNDS
No refunds given on completed work or after work has begun on your commission. If no work has begun, a full refund is possible (minus installments through Etsy/Klarna or bank transfer fees). I reserve the right to cancel and refund the commission for any reason at any time, for example, if there is failure to follow terms and conditions delineated in this terms of service.

KILL FEE
If I have to refund and cancel an unfinished commission, I will refund 50% of the original rate and keep the other 50% as a standard industry kill fee in compensation for the work started thus far. However, I try to avoid canceling unfinished commissions and only cancel if I feel very uncomfortable. (while I am single and looking; a commission request is not the time and here is not the place.)

USAGE TERMS
When placing your commission, you agree to all terms presented in this commission info and terms of service.
I retain the full copyright of the commissioned artwork but I am also agreeing NOT to make prints of your commission to sell on other platforms. I do not claim any ownership over your character: you own your character. I retain the right to upload the finished artwork in my portfolio and use it to promote my artwork.

USAGE RIGHTS: private, non-commercial use only
These portrait sketch commissions are for non-commercial, private usage only. The client still owns their own character and the design, but not the copyrights to the commissioned artwork. You may use the commissioned artwork for personal, non-commercial purposes such as printing the artwork for your own personal purposes or as a gift, or use it in your private games as your character token. Private use means the client is paying for the work & time of the artist (myself), but not for the commercial usage rights/license. The full copyright of the artwork itself remains with the artist (myself).
The client has the right to use the finished commission as a reference for further commissions done by other artists. Social media posting is okay, as long as the usage is personal and the client does not use the artwork to promote something they, for example, intend to sell or publish.
Prohibited usages
The client CAN NOT sell or license the artwork, mint the artwork as an NFT, use it for promotion or advertising purposes (social media marketing, for example), re-distribute, alter, claim the artwork as your own, or gain monetary profit from the artwork. The client can post & upload the artwork online to their social media page or any of your websites, giving proper credit to Nikole McDonald Jones as the artist. You can also use the artwork as your avatar or profile picture. If you post it online: always post a small, low-resolution image online to avoid art theft. Never post the unwatermarked, full-resolution version to online spaces to avoid art theft of your character. Prohibited usages related to machine learning technology (otherwise known as Generative AI “tools”.)
The client is not allowed to use the commissioned artwork for any purposes related to machine learning technologies / “AI” image-generating technologies. The client is not allowed to change or adjust the commissioned artwork through the use of machine learning and AI technologies. The client is not allowed to create derivatives of the commissioned artwork through the use of machine learning or derived technologies. Prohibited usages related to NFTs
The client is not allowed to mint the artwork as an NFT.
